In consideration of being permitted to participate in training activities provided by Elite Player Development Buffalo LLC (“EPD Buffalo”), I, for myself and/or on behalf of my minor child, agree to the following terms.
This Agreement applies to all related activities, including but not limited to small-group training sessions, private lessons, camps, clinics, conditioning programs, skills training, and all related activities (collectively, the “Activities”), whether conducted indoors or outdoors.
1. ACKNOWLEDGMENT OF PHYSICAL CONDITION
I acknowledge that I and/or my child are physically fit, medically able, and adequately prepared to participate in the Activities. I understand that soccer training involves physical exertion and athletic movements. I agree that participation will immediately stop if unsafe conditions exist or if illness, pain, dizziness, or injury occurs.
2. EMERGENCY MEDICAL AUTHORIZATION
I authorize Elite Player Development Buffalo LLC, its owners, members, managers, coaches, trainers, employees, independent contractors, volunteers, facility owners, landlords, and affiliated parties (collectively, the “Releasees”) to obtain emergency medical treatment or transportation if deemed necessary in their sole discretion.
I understand and agree that I am solely responsible for all costs related to medical treatment, transport, or care provided.
3. RULES, CONDUCT, AND COMPLIANCE
I agree to follow all rules, safety guidelines, instructions, and codes of conduct established by Elite Player Development Buffalo LLC. I understand that failure to follow instructions or unsafe behavior may result in removal from participation without refund.
I also agree to comply with all applicable federal, state, and local laws and regulations.
4. ASSUMPTION OF RISK
I understand that participation in training and athletic activities involves inherent and other risks, including, but not limited to:
• Slips, trips, and falls
• Collisions with other participants, coaches, goalposts, balls, or training equipment
• Muscle strains, pulls, sprains, tears, cramping, or overuse injuries
• Injuries to the knees, ankles, feet, hips, back, arms, hands, head, or neck
• Concussions or other head injuries
• Uneven, wet, artificial, or natural playing surfaces
• Weather-related conditions
• Actions or inactions of other participants
• Equipment failure or misuse
• Exposure to communicable illnesses
I understand these risks may result from my own actions or inactions, the actions or inactions of others, environmental conditions, or the ordinary negligence of the Releasees.
I knowingly and voluntarily assume all risks, known and unknown, including the risk of serious injury, permanent disability, emotional distress, or death.
5. CONCUSSION AWARENESS AND ACKNOWLEDGMENT
I understand that soccer is a contact sport and that participation may result in concussions or other traumatic brain injuries.
I understand that a concussion is a brain injury that may be caused by a blow to the head, face, neck, or body, and that symptoms may include headache, dizziness, confusion, balance problems, nausea, sensitivity to light or noise, emotional changes, or loss of consciousness. I understand that symptoms may not appear immediately and may worsen hours or days after participation.
I agree that if I or my child experience, or are suspected of experiencing, any signs or symptoms of a concussion, participation will immediately stop and appropriate medical evaluation will be sought. I understand that medical clearance from a qualified healthcare professional may be required prior to return to activity.
I acknowledge that Elite Player Development Buffalo LLC coaches and staff are not medical professionals and are not responsible for diagnosing or treating concussions.
I voluntarily assume all risks associated with concussions, including the risk of second-impact syndrome, permanent impairment, or long-term neurological effects, and release the Releasees from liability to the fullest extent permitted by New York law.
6. RELEASE AND WAIVER OF LIABILITY
I hereby release, waive, discharge, and hold harmless the Releasees from any and all claims, demands, actions, or causes of action arising out of or related to participation in the Activities, including claims arising from the ordinary negligence of the Releasees, to the fullest extent permitted
by law.
7. INDEMNIFICATION
I agree to defend, indemnify, and hold harmless the Releasees from any claims, damages, losses, liabilities, or expenses (including attorneys’ fees) arising out of my participation or the participation of my minor child in the Activities.
8. MEDIA RELEASE AUTHORIZATION
I grant permission to Elite Player Development Buffalo LLC to photograph, video record, and/or otherwise capture my likeness during participation in program activities. I further grant Elite Player Development Buffalo LLC the right to use, reproduce, publish, and distribute such photographs, video recordings, or other media in whole or in part, for lawful purposes including but not limited to:
• Website and social media content
• Promotional materials and marketing
• Newsletters, brochures, and advertisements
• Educational or informational content
9. GOVERNING LAW AND SEVERABILITY
This Agreement shall be governed by and interpreted in accordance with the laws of the State of New York. If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
10. ACKNOWLEDGMENT AND SIGNATURE
I acknowledge that I have carefully read this Agreement, fully understand its terms, and voluntarily agree to be bound by it. I understand that by signing this Agreement, I am giving up substantial legal rights.
MINOR PARTICIPANT RELEASE
If the participant is under the age of 18, I certify that I am the participant’s parent or legal guardian. I consent to the minor’s participation in the Activities and agree to all terms of this Agreement on the minor’s behalf. I agree to defend, indemnify, and hold harmless the Releasees from any claims arising from the minor’s participation.
